1. Acceptance of Terms
These Patient Terms of Service ("Terms") are a binding agreement between you ("Patient," "you," or "your") and HEVA INC. ("heva," "we," "our," or "us"). They govern your access to and use of the heva website, web app, and related services (collectively, the "Platform").
By creating an account, booking a consultation, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and to our separate Privacy Policy.
2. Description of Service
heva is an AI-enabled marketplace that:
- Lists licensed healthcare providers ("Doctors") and the medical procedures they offer.
- Facilitates messaging and consultation scheduling between Patients and Doctors.
- Processes payments on behalf of Doctors through Stripe.
heva does not itself provide medical advice, diagnosis, treatment, or healthcare services, and is not a medical provider. Doctors are independent professionals solely responsible for all care they deliver.
3. Eligibility & Account Security
- You must be 18 years or older, or the age of majority in your jurisdiction, to use the Platform.
- If you are under 18, a parent or legal guardian must create and manage the account and consent to these Terms.
- You agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for all activity under your account.
4. Patient Obligations
- Provide truthful medical history and any images or documents requested by the Doctor.
- Follow the Doctor's instructions and local laws regarding travel, prescriptions, and post-procedure care.
- Refrain from posting unlawful, offensive, or infringing content on the Platform.
5. Consultations, Fees & Payments
- Fees. Each consultation fee is set by the Doctor. heva adds a service fee of 5% – 10% to cover payment processing and administrative costs.
- Payment processing. All payments are handled by Stripe; your payment details never touch heva's servers.
- Currency & taxes. Charges are processed in the currency displayed at checkout; you are responsible for any bank fees or taxes.
- Finality & refunds. Payments are generally non-refundable once a consultation takes place, except (a) where the Doctor authorises a refund, or (b) as required by applicable law.
- Cancellations. If you cancel a scheduled consultation, the Doctor's own cancellation policy will apply.
6. No Medical Advice
- Content on the Platform—including AI-generated chat responses—is for informational and administrative purposes only.
- Always seek the advice of a qualified healthcare professional with any questions about a condition or procedure.
- Never disregard professional advice or delay seeking it because of information on the Platform.
7. Privacy & Data Security
Your personal and medical information is handled in accordance with our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of information as described there.
8. Disclaimers
- The Platform and all content are provided "as is" and "as available." heva makes no warranties, express or implied, regarding (a) the accuracy of listings or content, or (b) the quality or outcome of care provided by Doctors.
- heva does not guarantee that the Platform will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law:
- heva is not liable for any medical decisions, treatments, outcomes, injuries, or losses arising from your interactions with Doctors.
- heva's total liability to you for any claim arising out of or relating to the Platform will not exceed the greater of (i) USD 100 or (ii) the total service fees you paid to heva in the 12 months preceding the claim.
- heva is not liable for any indirect, incidental, special, consequential, or punitive damages.
10. Indemnification
You agree to indemnify and hold harmless heva and its affiliates, officers, directors, employees, and agents from any claim or demand (including reasonable attorneys' fees) arising out of or related to:
- Your breach of these Terms;
- Any interaction or dispute between you and a Doctor;
- Content you submit to the Platform.
11. Termination
- You may close your account at any time by contacting support@heva.co.
- heva may suspend or terminate your account, or remove content, if we believe you have violated these Terms or applicable law. Upon termination, Sections 6–11 survive.
12. Changes to Terms
heva may modify these Terms from time to time. Updated Terms will be posted with a new "Effective Date." Material changes will be notified in advance via the Platform or email. Continued use of the Platform after the Effective Date is deemed acceptance of the revised Terms.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction.
